1.1 Monyglob (Proprietary) Limited ( "Monyglob") values the confidentiality of personal data. This Privacy Policy and Consent Statement governs the data processing of the platform (the "Platform") and details of how we use and protect personal data of data subjects, in accordance with the Data Protection Act 32 of 2018 ("DPA"), its regulations, and any directives or guidance notes of the Information and Data Protection Commission ("IDPC"), and other relevant laws of the Republic of Botswana.

1.2 It shall be understood that the term "personal data" includes personal information, sensitive personal information, and privileged information. For the exact definitions, please refer to the text of the DPA.

2.1 In principle, you voluntarily provide your personal information to us, and you are not obligated to provide us with your personal data. However, if you refuse to provide or decide to withdraw your personal data, you may experience disadvantages, such as inability to use various services provided by us.

2.2 We may collect personal data directly from you, as a data subject, through several means, including but not limited to the following:

  • 2.3.1 Name of the registered user;

  • 2.3.3 Mobile number;
  • 2.3.4 Demographic data;
  • 2.3.5 Locality/address;
  • 2.3.6 Any other categories of personal information necessary for the purposes of marketing and public relations activities and business operations.

3. How We Use Your Personal Information

3.1 We may collect and process your personal data in relation to marketing, business operations and public relations activities, such as:

  • 3.1.1 value added services to you;
  • 3.1.2 organisation of business events, contests and promotions;
  • 3.1.2 sending product information;
  • 3.1.3 sending brochures/newsletters;
  • 3.1.4 updating social networking pages and improving Monyglob's online presence;
  • 3.1.5 replying to enquiries;
  • 3.1.6 processing subscribers and their personal information;
  • 3.1.7 maintaining operational and contact details;
  • 3.1.8 managing and evaluating Monyglob's relationships with its business partners and communication with them.

4. How Monyglob Shares Your Personal Information

As a general rule, Monyglob does not and will not share personal data with third parties. However, when Monyglob needs to make certain disclosures from time to time, such as when it is necessary for the proper execution of processes related to the above-mentioned declared purposes, or the use or disclosure is reasonable necessary, required or authorised by or under law. Monyglob may share your personal information with third parties within and outside the Republic of Botswana, such as strategic partners, service providers, corporate affiliates and corporate business transactions, and its local offices but, Monyglob shall require adherence by said third parties to similar or comparable data protection standards as required by the DPA.

5. Security

Monyglob has implemented technological, organisational and physical security measures to protect personal data from accidental or unlawful destruction, alteration, and disclosure, as well as against any other unlawful processing. Any personal data held by it or on its behalf is stored on secure servers, with modern security measures in place to protect against accidental or unlawful destruction, alteration, and disclosure, and any other unlawful processing. The personal data disclosed by the data subject may be accessed or processed only by authorised personnel who hold such information under strict confidentiality. Where such personal data is held by third parties on its behalf, it shall once more require adherence by said third parties to similar or comparable data protection standards as required by the DPA to ensure the confidentiality and security of such data.

However, while Monyglob will take all reasonable measures (as required by applicable law) to protect the integrity of such information, it cannot guarantee that loss, unauthorised access or alterations, or misuse will not occur. Any data security incident or breach that comes to its knowledge will be recorded and reported as required by law. Monyglob will take all necessary and reasonable steps to address such incident or breach and mitigate against any negative effect of such incident or breach. If there is strong suspicion that an incident affects the data subject's personal information, it will notify the data subject of such incident in an appropriate manner.

6. Retaining Personal Information

Monyglob will periodically review the personal data held by it to ensure that it is accurate and up to date. It will also retain your personal data only for so long as it is necessary for the fulfillment of the purposes for which the data was obtained or for the establishment, exercise or defense of legal claims, or for legitimate business purposes, or as provided by applicable laws, rules, and regulations.

You are given certain rights under the DPA, its regulations, and any directives or guidance notes, such as the:

  • 7.2 Right to access;
  • 7.3 Right to rectify or to correct erroneous data;
  • 7.4 Right to erase or block;
  • 7.5 Right to secure data portability;
  • 7.6 Right to be indemnified for damages;
  • 7.7 Right to file a complaint.

The decisions to provide access, consider requests for correction or erasure, and address objection to process personal data as it appears in official records, are always subject to applicable and relevant laws and/or the DPA, its regulations, and any directives or guidance notes of the IDPC.

CONSENT

By using this Platform or application, I consent to the collection, generation, use, processing, storage and retention of personal data by the Platform for the purpose/s described above.
